Abstract

Indonesia as a developing country currently has many forms of technological progress. The increasing desires of society along with technologicaldevelopments have made one form of technological development, namely e-commerce, very popular and widely used by the public. The development of e-commerce itself in Indonesia has been very rapid. In Indonesia, there are several e-commerce companies engaged in the trading of living necessities, entertainment, food necessities, tickets and so on. E-commerce is very popular with the public because of the easy access to people's needs just through gadgets, one of the easiest to access is a cell phone or mobile phone. One of the most popular e-commerce in Indonesia is Traveloka, where Traveloka operates in the tourism and lifestyle sector which provides buying and selling of plane tickets, buses, trains, accommodation and vehicle rentals. Unfortunately, in its implementation, several consumers felt disadvantaged due to inconsistency in the provisions provided by Traveloka and agents with Traveloka as third parties. This ultimately causes losses suffered by consumers. This research discusses forms of protection for consumers regarding the losses they experience. The results of this research show that consumers who suffer losses should be the responsibility of the agent, apart from that Traveloka as a platform provider must still be responsible for helping consumers connect with the agent concerned. What the agent at Traveloka did was a breach of contract, because the agent failed to fulfill the performance that had been agreed with the consumer.
