Pengelolaan Sumber Daya Alam Berbasis Transendensi Hukum Antara Pemerintah Daerah Dengan Masyarakat

Abstract

One of the areas that has potential natural resources is Batu City with the nickname of the City of Agritourism. However, the penetration of economic capital has changed the identity of Batu City in such a way. Slowly but surely the natural beauty of this city began to be tarnished by the massive development of artificial tourism which had an impact on the natural ecosystem and also reduced the welfare and local wisdom of the community. Therefore, the purpose of this research is to offer a discourse on the purification of natural resource management policies through the Javanese spiritual concept of "Memayu Hayuning Bawana †which emphasizes the importance of protecting nature based on the nature of transcendence, namely the relationship between God, the universe and humans. This research is a normative (legal) research. The results of this study conclude: First, currently there has been an erosion of legal transcendence values in the management of natural resources in several regions including Batu City. This is characterized by the dominant role of the state (Government) in terms of natural resource management which is strongly motivated by the meanings of their rationality. This interpretation leads to exploitative actions that have a destructive impact on the environment. Second, seeing the fact of the massive exploitative actions against natural resources in Batu City, it is very important to purify natural resource management which is realized through a one-way relationship between the Regional Government and the Community based on the Javanese philosophical value of “Memayu Hayuning Bawanaâ€. This foundation becomes important in the philosophical-juridical-ecological frame to be used as the basis for any discussion of future natural resource management legal policies.
